Entire Agreement: This agreement contains the entire understanding between SLS-Photography and the CLIENT in regards to the wedding photography coverage. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. This agreement shall be governed by the laws of the State of Idaho.

Safe Environment: It is understood that the CLIENT is responsible for providing a safe and professional atmosphere for our Photographers and other staff to work. If at any time our Photographer feels it is an unsafe/unprofessional environment, the package will be considered complete and our Photographers and staff may leave, and you shall not be entitled to any refund of the package price. It is also understood that our Photographers will not work in environments outside the photographic equipment’s designed working parameters.

Abuse: CLIENT or person or person, family member including guests attending the event shall not abuse the Photographer in any shape or form including physical or verbal abuse, even the use of profanity or hostel tone is considered default and the package will be considered complete and our Photographers and staff may leave, and you shall not be entitled to any refund of the package price.

Returned Checks: Personal checks returned due to insufficient funds will be charged a $40.00 fee, and remaining balances must be paid by cash or money order. Any charges incurred to collect payment due for SLS-Photography will be the responsibility of the CLIENT.

Orders: Package enlargements, allowances, and other items included in the package or prepaid with this contract must be ordered within 120 days of the event date, or be subject to current standard prices, should the standard prices increase during the 120 days. Order instructions will be supplied to you upon delivery of your proofs, or are available online at www.sls-photography.com.

Exclusive Photographer: The Photographer shall be the exclusive Photographer retained by the CLIENT for the purpose of photographing the wedding. Family and friends of the CLIENT shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties and do not photograph poses arranged by the Photographer.

Failure to preform: If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the CLIENT but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damage without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the CLIENT’s order.

Inherent Qualities: CLIENT is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, environment, and acts of god and CLIENT releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

Travel: A fee is added to CLIENTS dues if the Photographer has to travel outside of SLS-Photography’s service area. (Post Falls, Coeur d’ Alene, Dalton Gardens, Rathdrum, Hayden) A millage fee will be charged when a Photographer has to travel outside these city limits.

Archiving: SLS-Photography is not liable for any damage to the original digital files beginning one (1) year following the wedding date. After one (1) year there is a $50.00 retrieval fee, for creating additional prints or other services requested.

Formal Photographs: The bride and or groom agree to set aside at least a 45-minute time frame after or before the ceremony for formal photographs. If the bride or grooms late arrival prevents this time from occurring the Photographer shall not be held liable for failure to take desired photographs.

Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. SLS-Photography recommends that CLIENT designate an “event guide” to point out important individuals for informal or candid photographs to the Photographer during the wedding that they wish to have photographed. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. SLS-Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to SLS-Photography.

Shooting Time: The photography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and SLS-Photography agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.
Overtime: Because we may book another photographic session before or after yours, it is advisable that you book the package with the number of hours that best suits your event. Upon signature and receipt of your deposit, SLS-Photography will reserve the time and date agreed, therefore all deposits are non-refundable. If the date of the event needs to be changed, we will review on a case by case basis to determine if the deposit will carry forward to the new date. If you must change the date, let us know as early as possible so we can review the case. In most circumstances we can carry the deposit forward to a new date and time, provided we have that date/time available.

Exhibition: CLIENT grants SLS-Photography permission to display selected images resulting from this assignment as an example of SLS-Photography’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images.

Model Release: The CLIENT hereby grants to SLS-Photography and its legal representatives and assignees, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases SLS-Photography and its legal representatives and assigns from all claims and liability relating to said photographs.

Photographic Materials: All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer and are protected by Federal Copyright Law. The Photographer shall make proofs and previews available to the CLIENT for the purpose of selecting photographs. All photographs are copyrighted. It is illegal to reproduce professional photographs.

Copyright and Reproductions: The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the CLIENT or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the CLIENT. All photographs are copyrighted. It is illegal to reproduce professional photographs.

Client Use: The CLIENT is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions there of by parties other than the Photographer. If CLIENT is obtaining a print for newspaper announcement of the wedding, Photographer authorizes CLIENT to reproduce the print in this manner. In such event, CLIENT shall request that the newspaper run a credit for the Photographer adjacent to the photograph, but shall have no liability if the news paper refuses or omits to do so. All photographs are copyrighted. It is illegal to reproduce professional photographs.

It is illegal to copy or reproduce these photographs in any manner without the Photographer’s permission, and violators of this federal law will be subject to its civil and criminal penalties. This includes scanning for printing, printing or website use in any manner.

Limit of Liability: In the unlikely event that the Photographer is injured or becomes too ill to photograph the event, SLS-Photography will make every effort to secure a replacement Photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. SLS-Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond SLS-Photography’s control, up to 120 days after the event date, SLS-Photography liability is limited to the return of all payments received for the event package.

Cancellation: In the event of cancellation, the security deposit is non-refundable. It shall be liquidated damages to SLS-Photography in the event of a breach of contract by CLIENT. The CLIENT shall also be responsible for payment for any SLS-Photography materials charges incurred up to time of cancellation.

Breach: In the event of non-payment of amount due on __/__/____ this agreement will be considered cancelled and subject to the cancellation policy above. At the sole discretion of SLS-Photography, the agreement may be reinstated by paying the entire balance of the photography fee agreed to.

Completion Schedule: Editiing and Proof CD creation takes approximately three to four weeks

Payment Schedule: 50% of the total price is due at time of signing of agreement.
